The protection of Personal Data, as a fundamental commitment of YVY to its employees, customers, suppliers, and partners, is ensured by strict compliance with all applicable legislation regarding the protection of Personal Data in force, considering the best market practices and in accordance with the highest ethical standards.

Purpose

This policy regulates the retention and processing of Personal Data in the context of the employment, contractual, or service relationships established between a Data Subject and YVY.

With Whom Will Your Personal Data Be Shared?

In order to continuously enhance the quality of our services and products, we collaborate with other entities that may handle certain personal data of users of our website. When collaborating with these entities, we require them to ensure compliance with applicable laws and regulations, and we assess their competencies in the field of personal data processing.

How Long Will YVY Retain Your Personal Data?

YVY is obligated, as per applicable laws, to retain the personal data collected for the time necessary to fulfill the purposes mentioned earlier, without prejudice to the data subject's right to object or be forgotten, and furthermore, in cases where the Data Subject withdraws their consent, where applicable.
 

The retention of physical and digital Personal Data by YVY will be conducted for the strictly necessary and legally required period, after which YVY will delete, destroy, or anonymize such data.
 

The applicable legal deadlines as of the present date are as follows:

  • Recruitment: a period of 5 years (Article 32 of Law No. 7/2009 of February 12);

  • Registration of Managers and Employees: a period of 5 years after the departure of the manager/employee, during which corrections can be made regarding tax and social security matters;

  • Training and Performance Evaluation: until the end of the employment relationship;

  • Proof of payment of social security contributions and tax authority, pay slips, and payroll processing: a period of 10 years (or 12 years for documents relating to the tax periods of 2014 and 2015), necessary period for the retention of accounting documents (Article 123 CIRC);

  • Health data: the data will be kept for a minimum period of 40 years (Article 46 of Law 102/2009).

What Rights Do You Have as a Data Subject?

Under the GDPR and other applicable legislation, as the data subject of your personal data, you have a set of rights regarding your data and how they are processed, which can be exercised at any time. These rights include:

  • Right to information, access, rectification, or erasure of personal data;

  • Right to data portability;

  • Right to restrict or object to the processing of your data (where applicable);

  • Right to lodge a complaint with the Supervisory Authority;

  • Right to withdraw consent.
